(Required) Terms of Service

**Article 1 (Purpose)** The purpose of these Terms of Service is to stipulate the rights, obligations, and responsibilities of the cyber mall and the user in connection with the use of internet-related services (hereinafter referred to as the "Service") provided by the OOOO shopping mall (hereinafter referred to as the "Mall") operated by the OOOO company (an e-commerce business operator, hereinafter referred to as the "Company"). ※「These Terms of Service shall apply mutatis mutandis to e-commerce utilizing PC communication, wireless, etc., unless it is contrary to its nature.」 **Article 2 (Definition)** 1. "Mall" refers to a virtual storefront established by the "Company" to trade goods or services (hereinafter referred to as "Goods, etc.") with users using information and communication facilities such as computers, and is also used to refer to the business operator operating the cyber mall. 2. "User" refers to members and non-members who access the "Mall" and receive the services provided by the "Mall" in accordance with these Terms of Service. 3. "Member" refers to a person who has registered as a member of the "Mall" and can continuously use the services provided by the "Mall." 4. "Non-member" refers to a person who uses the services provided by the "Mall" without registering as a member. **Article 3 (Display, Explanation, and Amendment of Terms of Service)** 1. The "Mall" shall post the contents of these Terms of Service, the name of the company and representative, the address of the business office (including an address where consumer complaints can be handled), telephone number, fax number, email address, business registration number, mail-order business report number, and the privacy protection officer on the initial service screen (front page) of the cyber mall so that users can easily recognize them. However, the contents of the Terms of Service may be viewed by the user through a connected screen. 2. Before the user agrees to the Terms of Service, the "Mall" must provide a separate connected screen or pop-up screen to obtain the user's confirmation so that the user can understand important contents such as order cancellation, delivery responsibility, and refund conditions stipulated in the Terms of Service. 3. The "Mall" may amend these Terms of Service to the extent that it does not violate relevant laws, such as the Act on the Consumer Protection in Electronic Commerce, etc., the Act on the Regulation of Terms and Conditions, the Framework Act on Electronic Documents and Transactions, the Electronic Financial Transactions Act, the Electronic Signature Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc., the Door-to-Door Sales, etc. Act, and the Framework Act on Consumers. 4. If the "Mall" amends the Terms of Service, it shall specify the effective date and the reason for the amendment and announce it on the initial screen of the mall along with the current Terms of Service from 7 days before the effective date to the day before the effective date. However, if the terms are changed unfavorably to the user, a grace period of at least 30 days will be given. In this case, the "Mall" will clearly compare the contents before and after the revision to make it easy for the user to understand. 5. If the "Mall" amends the Terms of Service, the amended Terms of Service shall apply only to contracts concluded after the effective date, and the provisions of the Terms of Service before the amendment shall apply to contracts already concluded before that date. However, if a user who has already signed a contract wishes to be subject to the amended Terms of Service and transmits such intent to the "Mall" within the notice period under Paragraph 3 and obtains the consent of the "Mall," the amended Terms of Service shall apply. 6. Matters not specified in these Terms of Service and the interpretation of these Terms of Service shall be governed by the Act on the Consumer Protection in Electronic Commerce, etc., the Act on the Regulation of Terms and Conditions, the Consumer Protection Guidelines in Electronic Commerce, etc. set by the Fair Trade Commission, and other related laws or commercial practices. **Article 4 (Provision and Modification of Service)** 1. The "Mall" shall perform the following tasks: - Providing information on Goods, etc., and concluding a purchase contract. - Delivery of Goods, etc., for which a purchase contract has been concluded. - Other tasks designated by the "Mall." 2. The "Mall" may change the contents of the Goods, etc., to be provided by a contract to be concluded in the future in the event of a sell-out of Goods, etc., or a change in technical specifications. In this case, the changed contents of the Goods, etc., and the date of provision shall be specified and immediately posted where the current contents of the Goods, etc., are posted. 3. If the contents of the service contracted with the user are changed due to reasons such as a sell-out of Goods, etc., or a change in technical specifications, the "Mall" shall immediately notify the user of the reason at an address where the user can be reached. 4. In the case of the preceding paragraph, the "Mall" shall compensate the user for damages caused by this. However, this shall not apply if the "Mall" proves that there is no intention or negligence on its part. **Article 5 (Suspension of Service)** 1. The "Mall" may temporarily suspend the provision of services in the event of maintenance, inspection, replacement, breakdown of information and communication facilities such as computers, or interruption of communication. 2. The "Mall" shall compensate the user or a third party for damages suffered due to the temporary suspension of the service for the reasons stated in Paragraph 1. However, this shall not apply if the "Mall" proves that there is no intention or negligence on its part. 3. In the event that the service cannot be provided due to reasons such as a change in business items, abandonment of business, or integration between companies, the "Mall" shall notify the user in the manner specified in Article 8 and compensate the consumer according to the conditions originally suggested by the "Mall." However, if the "Mall" has not notified the compensation standards, etc., the "Mall" shall pay the users their mileage or accumulated points in kind or cash equivalent to the currency value used in the "Mall." **Article 6 (Membership Registration)** 1. The user applies for membership by filling in their member information according to the registration form set by the "Mall" and expressing their agreement to these Terms of Service. 2. The "Mall" shall register the user who has applied for membership as described in Paragraph 1 as a member, unless the user falls under any of the following subparagraphs: - If the applicant has previously lost membership status under Article 7 (3) of these Terms of Service, except when 3 years have passed since the loss of membership and the applicant has obtained approval from the "Mall" for re-registration. - If there is any false information, omission, or typographical error in the registered details. - If registering as a member is judged to be significantly difficult due to the "Mall's" technical reasons. 3. The time of establishment of the membership contract shall be the time when the approval of the "Mall" reaches the member. 4. If there is a change in the registered information at the time of membership registration, the member must notify the "Mall" of the change within a reasonable period of time through methods such as editing their member information. **Article 7 (Withdrawal of Membership and Loss of Eligibility, etc.)** 1. A member may request withdrawal from the "Mall" at any time, and the "Mall" shall process the membership withdrawal immediately. 2. If a member falls under any of the following reasons, the "Mall" may restrict or suspend their membership: - Registering false information upon application. - Failing to pay the price of Goods, etc., purchased through the "Mall" or other debts incurred by the member in relation to the use of the "Mall" by the due date. - Threatening the electronic commerce order, such as interfering with others' use of the "Mall" or misappropriating their information. - Using the "Mall" to commit acts prohibited by laws or these Terms of Service, or against public order and morals. 3. If the "Mall" restricts or suspends membership and the same act is repeated twice or more, or if the reason is not corrected within 30 days, the "Mall" may revoke the membership. 4. If the "Mall" revokes membership, the membership registration will be canceled. In this case, the member will be notified, and they will be given an opportunity to explain themselves for at least 30 days prior to the cancellation of registration. **Article 8 (Notification to Members)** 1. If the "Mall" makes a notification to a member, it may be sent to the email address designated by the member in advance with the "Mall." 2. In the case of a notification to an unspecified number of members, the "Mall" may substitute individual notifications by posting it on the "Mall's" bulletin board for at least 1 week. However, individual notifications will be given for matters that significantly affect the member's own transactions. **Article 9 (Purchase Application)** 1. A user of the "Mall" shall apply for a purchase on the "Mall" by the following or similar methods, and the "Mall" must provide the following information in an easy-to-understand manner when the user applies for a purchase: - Searching and selecting Goods, etc. - Entering the recipient's name, address, telephone number, email address (or mobile phone number), etc. - Confirming the contents of the Terms of Service, services for which the right to cancel an order is restricted, and details related to costs such as delivery fees and installation fees. - Indicating agreement to these Terms of Service and confirming or rejecting item 3 above (e.g., by checking a box). - Application for the purchase of Goods, etc., and confirmation of this, or consent to the "Mall's" confirmation. - Selection of payment method. 2. If the "Mall" needs to provide or entrust a buyer's personal information to a third party, it must obtain the buyer's consent at the time of the actual purchase application and shall not obtain comprehensive consent in advance at the time of registration. At this time, the "Mall" must explicitly specify to the buyer the personal information items provided, the recipient, the recipient's purpose of using the personal information, and the retention and use period. However, if relevant laws dictate otherwise, such as the consignment of personal information processing under Article 25 (1) of the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc., those regulations shall be followed. **Article 10 (Formation of Contract)** 1. The "Mall" may not accept a purchase application as described in Article 9 if it falls under any of the following subparagraphs. However, when concluding a contract with a minor, it must be notified that if the consent of the legal representative is not obtained, the minor or the legal representative may cancel the contract: - If there is any false information, omission, or typographical error in the application. - If a minor purchases goods and services prohibited by the Juvenile Protection Act, such as tobacco and alcohol. - If accepting the purchase application is judged to be significantly difficult due to the "Mall's" technical reasons. 2. The contract is deemed to be formed at the time the "Mall's" acceptance reaches the user in the form of an acknowledgment notice under Article 12 (1). 3. The "Mall's" declaration of acceptance must include information regarding the confirmation of the user's purchase application, availability for sale, and correction or cancellation of the purchase application. **Article 11 (Payment Methods)** Payment for Goods or services purchased at the "Mall" may be made by any of the following methods available. However, the "Mall" cannot collect any additional fees under any pretext regarding the user's payment method for the Goods, etc.: 1. Various account transfers such as phone banking, internet banking, and mail banking. 2. Various card payments such as prepaid cards, debit cards, and credit cards. 3. Online direct bank deposit. 4. Payment by electronic currency. 5. Payment upon receipt. 6. Payment by points paid by the "Mall," such as mileage. 7. Payment by gift certificates contracted with or recognized by the "Mall." 8. Payment by other electronic payment methods, etc. **Article 12 (Notice of Receipt, Change, and Cancellation of Purchase Application)** 1. The "Mall" notifies the user of the receipt of the order when there is a purchase application from the user. 2. The user who receives the acknowledgment notice may request a change or cancellation of the purchase application immediately after receiving the notice if there is any discrepancy in their intention, and the "Mall" must process it without delay according to the request if it is before delivery. However, if payment has already been made, it shall follow the provisions on order cancellation, etc., in Article 15. **Article 13 (Supply of Goods, etc.)** 1. Unless there is a separate agreement regarding the supply timing of the Goods, etc., the "Mall" takes necessary measures such as custom production and packaging so that the Goods, etc., can be delivered within 7 days from the day the user made the subscription. However, if the "Mall" has already received all or part of the payment for the Goods, etc., it will take action within 3 business days from the date of receiving all or part of the payment. At this time, the "Mall" takes appropriate measures so that the user can check the supply procedure and progress of the Goods, etc. 2. The "Mall" specifies the delivery method, who bears the delivery cost for each method, and the delivery period for each method for the Goods purchased by the user. If the "Mall" exceeds the agreed delivery period, it must compensate for the damages caused to the user. However, this does not apply if the "Mall" proves that there is no intent or negligence. **Article 14 (Refund)** When the "Mall" is unable to deliver or provide the Goods, etc., for which the user has applied for purchase due to reasons such as being out of stock, it shall notify the user of the reason without delay. If payment for the Goods, etc., has been received in advance, the "Mall" shall refund the payment or take measures necessary for a refund within 3 business days from the date of receiving the payment. **Article 15 (Withdrawal of Offer, etc.)** 1. A user who has concluded a contract with the "Mall" regarding the purchase of Goods, etc., may withdraw the offer within 7 days from the date of receiving the document on the contents of the contract under Article 13 (2) of the Act on the Consumer Protection in Electronic Commerce, etc. (if the supply of Goods, etc., is later than when the document was received, it refers to the date the Goods, etc., were supplied or the supply began). However, if the Act on the Consumer Protection in Electronic Commerce, etc. dictates otherwise regarding the withdrawal of an offer, those provisions shall apply. 2. A user cannot return or exchange the Goods, etc., if they fall under any of the following subparagraphs after receiving them: - If the Goods, etc., are lost or damaged due to reasons responsible to the user (however, if the packaging is damaged to check the contents of the Goods, etc., the offer may be withdrawn). - If the value of the Goods, etc., has significantly decreased due to the user's use or partial consumption. - If the value of the Goods, etc., has significantly decreased over time to the extent that resale is difficult. - If the packaging of the original Goods, etc., is damaged in the case where the Goods can be reproduced into Goods with identical performance. 3. In the case of Paragraph 2, Items 2 to 4, if the "Mall" has not previously clearly stated in a place easily noticeable by consumers that the withdrawal of offers is restricted or provided trial products, the user's withdrawal of the offer is not restricted. 4. Notwithstanding the provisions of Paragraphs 1 and 2, if the contents of the Goods, etc., are different from the display or advertisement or performed differently from the contract, the user may withdraw the offer within 3 months from the date of receiving the Goods, etc., or within 30 days from the date they knew or could have known of the fact. **Article 16 (Effects of Withdrawal of Offer)** 1. The "Mall" shall refund the amount paid for the Goods, etc., within 3 business days of receiving the returned Goods, etc., from the user. In this case, if the "Mall" delays the refund of the Goods, etc., to the user, it shall pay delay interest calculated by multiplying the delayed period by the delay interest rate determined in Article 21-2 of the Enforcement Decree of the Act on the Consumer Protection in Electronic Commerce, etc. 2. In refunding the above amount, if the user paid for the Goods, etc., using a credit card or electronic currency, the "Mall" shall immediately request the business operator that provided the payment method to suspend or cancel the charge for the Goods, etc. 3. In the event of a withdrawal of an offer, the expenses required for returning the supplied Goods, etc., shall be borne by the user. The "Mall" does not claim penalties or damages from the user for reasons of withdrawal of the offer. However, if the contents of the Goods, etc., differ from the display/advertisement or the contract is performed differently and the offer is withdrawn, the "Mall" shall bear the expenses required to return the Goods, etc. 4. If the user bore the shipping cost when receiving the Goods, etc., the "Mall" clearly specifies who bears the cost upon withdrawal of the offer so that the user can easily understand it. **Article 17 (Privacy Protection)** 1. The "Mall" collects the minimum personal information necessary to provide services when collecting the user's personal information. 2. The "Mall" does not collect information necessary for executing a purchase contract in advance upon membership registration. However, this does not apply to cases where identity verification is required before a purchase contract to fulfill obligations under relevant laws, and the minimum specific personal information is collected. 3. When the "Mall" collects and uses a user's personal information, it notifies the user of the purpose and obtains consent. 4. The "Mall" cannot use the collected personal information for purposes other than the intended purpose. When a new purpose of use arises or when providing it to a third party, it notifies the user of the purpose at the stage of use or provision and obtains consent. However, exceptions are made if relevant laws stipulate otherwise. 5. If the "Mall" is required to obtain the user's consent under Paragraphs 3 and 4, it must specify or notify in advance the identity of the privacy protection officer (affiliation, name, telephone number, other contact details), the purpose of collection and use of information, and matters related to information provision to third parties (recipient, purpose of provision, and contents of information to be provided) as stipulated in Article 22 (2) of the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc., and the user may withdraw this consent at any time. 6. The user may request to view and correct errors in their personal information held by the "Mall" at any time, and the "Mall" is obliged to take necessary measures without delay. If the user requests correction of an error, the "Mall" does not use the personal information until the error is corrected. 7. To protect personal information, the "Mall" must limit the number of persons handling the user's personal information to a minimum and bears all responsibility for damages caused by the loss, theft, leakage, unauthorized provision to a third party, or alteration of the user's personal information, including credit card and bank account details. 8. The "Mall" or a third party who receives personal information from it shall destroy the personal information without delay when the purpose of collection or provision has been achieved. 9. The "Mall" does not set the consent box for the collection, use, and provision of personal information as pre-selected. In addition, it specifically outlines the services restricted upon the user's refusal to consent to the collection, use, and provision of personal information, and does not restrict or refuse the provision of services, such as membership registration, due to the user's refusal to consent to the collection, use, and provision of personal information that is not a mandatory collection item. **Article 18 (Obligations of the "Mall")** 1. The "Mall" shall not engage in acts prohibited by laws or these Terms of Service, or against public order and morals, and shall do its best to provide goods and services continuously and stably as provided in these Terms of Service. 2. The "Mall" must be equipped with a security system to protect users' personal information (including credit information) so that users can safely use the internet service. 3. If the "Mall" causes damages to a user through unfair labeling or advertising acts defined in Article 3 of the Act on Fair Labeling and Advertising regarding products or services, it shall be liable to compensate for such damages. 4. The "Mall" shall not send commercial emails for profit-making purposes against the user's explicit refusal. **Article 19 (Obligations regarding Member ID and Password)** 1. Except in the case of Article 17, the member is responsible for managing their ID and password. 2. Members must not let a third party use their ID and password. 3. If a member recognizes that their ID and password have been stolen or are being used by a third party, they must immediately notify the "Mall" and follow the instructions provided by the "Mall." **Article 20 (Obligations of the User)** Users shall not engage in the following acts: 1. Registering false information upon application or modification. 2. Misappropriating someone else's information. 3. Altering information posted on the "Mall." 4. Transmitting or posting information (computer programs, etc.) other than that designated by the "Mall." 5. Infringing the copyright or other intellectual property rights of the "Mall" or a third party. 6. Damaging the reputation of or interfering with the business of the "Mall" or a third party. 7. Disclosing or posting obscene or violent messages, images, audio, or other information against public order and morals on the mall. **Article 21 (Relationship between Linked "Mall" and Linked "Mall")** 1. When a parent "Mall" and a subsidiary "Mall" are connected via a hyperlink (e.g., hyperlinks may include text, pictures, and moving images), the former is called the linking "Mall" (website) and the latter is called the linked "Mall" (website). 2. If the linking "Mall" explicitly states on its initial screen or on a pop-up screen at the time of connection that it does not guarantee transactions conducted by the user with the goods, etc., independently provided by the linked "Mall," it shall not bear any guarantee responsibility for that transaction. **Article 22 (Attribution of Copyright and Restriction on Use)** 1. Copyrights and other intellectual property rights for works created by the "Mall" shall belong to the "Mall." 2. Users shall not use information obtained while using the "Mall" to which the "Mall" has intellectual property rights for commercial purposes by copying, transmitting, publishing, distributing, broadcasting, or other methods, nor let a third party use it, without the prior consent of the "Mall." 3. When the "Mall" uses copyrights attributed to the user according to an agreement, it must notify the user. **Article 23 (Dispute Resolution)** 1. The "Mall" installs and operates a damage compensation processing organization to reflect legitimate opinions or complaints raised by users and compensate for the damage. 2. The "Mall" prioritizes handling complaints and opinions submitted by users. However, if prompt processing is difficult, the "Mall" will immediately notify the user of the reason and processing schedule. 3. In the event of a user's request for damage relief related to an electronic commerce dispute between the "Mall" and the user, it may be subject to adjustment by a dispute mediation agency commissioned by the Fair Trade Commission or a City/Provincial Governor. **Article 24 (Jurisdiction and Governing Law)** 1. Lawsuits regarding electronic commerce disputes between the "Mall" and a user shall be based on the user's address at the time of filing, and if there is no address, it shall be under the exclusive jurisdiction of the district court having jurisdiction over the place of residence. However, if the address or residence of the user is unclear at the time of filing or if the user is a foreign resident, the lawsuit shall be filed in the competent court under the Civil Procedure Act. 2. South Korean law applies to electronic commerce lawsuits filed between the "Mall" and the user. **Addendum (Effective Date, etc.)** - These Terms of Service are effective from OOOO, OO, OO. - These Terms of Service comply with the Standard Terms and Conditions of Electronic Commerce (Internet Cyber Mall) No. 10023 (Revised on September 19, 2014).
